The Cost of Contested Divorce

A contested divorce in Kenya can take between two and five years to conclude in the Family Division of the High Court. Legal fees, court filing costs, and the emotional toll on children and both spouses make litigation the least desirable path where parties can reach agreement.

What is Mediation?

Mediation is a form of Alternative Dispute Resolution (ADR) where a neutral third party — the mediator — facilitates structured negotiations between the divorcing spouses. The mediator does not impose a decision; instead, they help both parties reach a mutually acceptable agreement on issues such as division of matrimonial property, custody and access, and maintenance.

Advantages of Mediation

Speed: a mediation process can be completed in weeks rather than years. Cost: mediation fees are a fraction of the cost of full litigation. Privacy: court proceedings are public; mediation is entirely confidential. Control: the parties craft their own solution rather than having a judge impose one. Co-parenting: mediation preserves the relationship between parties, which is critical where children are involved.

When is Litigation Necessary?

Mediation is not appropriate in every case. Where there is a history of domestic violence, a power imbalance, or one party is unwilling to negotiate in good faith, court proceedings may be the only option. Similarly, where urgent protection orders are needed, the court remains the appropriate forum.

The Legal Framework

Kenya's Civil Procedure Act and the Mediation Accreditation Committee Rules 2020 provide a framework for mediation. Agreements reached in mediation can be made into a consent order by the court, giving them the full force of a court judgment.
